    Elon Musk wins court victory in a dispute over a 2018 post during a labor dispute

    NEW ORLEANS — A federal agency was wrong to order that Tesla CEO Elon Musk delete a 2018 social media post that union leaders saw as a threat to employee stock options, a sharply divided federal appeals court has ruled.

    The case involved a post made on what was then known as Twitter during United Auto Workers organizing efforts at a Tesla facility in Fremont, California. The post was made years before Musk bought the platform, now known as X, in 2022.

    On May 20, 2018, Musk tweeted: “Nothing stopping Tesla team at our car plant from voting union. Could do so tmrw if they wanted. But why pay union dues and give up stock options for nothing? Our safety record is 2X better than when plant was UAW & everybody already gets healthcare.”

    The National Labor Relations Board said it was an illegal threat. After Tesla appealed, three judges on the 5th U.S. Circuit Court of Appeals in New Orleans upheld that decision, as well as a related NLRB order that Tesla rehire a fired employee, with back pay.

    But Tesla sought a rehearing, and the full 5th Circuit later threw out the earlier decision and voted to hear the matter again. In an opinion dated Friday, the judges split 9-8 in favor of Tesla and Musk.

    “We hold that Musk’s tweets are constitutionally protected speech and do not fall into the categories of unprotected communication like obscenity and perjury,” the unsigned opinion said.

    The majority also found the NLRB must reconsider its order that the fired employee be reinstated, saying there was no proof that the person who fired the worker acted out of ill will toward the union.

    The 11-page opinion was followed by a 30-page dissent on behalf of eight judges, written by Judge James Dennis.

    “Relevant here, the Supreme Court has consistently held that the First Amendment does not protect threatening, coercive employer speech to employees in the labor organization election context— the precise category of speech Musk disseminated via Twitter,” Dennis wrote.

    He also argued that the attitude of the supervisor who fired the worker was not relevant to whether he should be reinstated. The worker, Dennis wrote, “was fired for declining to divulge information about protected union activities during an interrogation.”

    The ruling sent the case back to the NLRB for further action. It was not immediately clear if there would be an appeal to the U.S. Supreme Court. The Associated Press sent an email to the UAW Tuesday seeking information on the union’s next move.

    Amul issued a public advisory on X (formerly Twitter) and urged customers to be aware of the fake Amul ghee packaging. As per the advisory, Amul revealed that they have switched to a “duplication proof” carton pack for the ghee to prevent adulteration. “This is for your kind information that fake and spurious Amul ghee is being packed and distributed in the market by a few unscrupulous agents,” read the guideline. A picture of the fake “ghee in the 1-litre refill pack” was also added to the post to give viewers a better idea of the counterfeit product.

    The advisory added, “Amul has stopped manufacturing its 1 Litre Refill Ghee pack from more than three years and has switched over to the  Duplication Proof carton pack. The new Amul ghee pack Duplication Proof carton helps to prevent any form of adulteration and is packed using highly sophisticated aseptic filling machines at our state-of-the-art ISO certificate diaries. Amul ghee is also available in Tin, Pouch and Jar packaging formats.”

Several people felt that the prices were steep. A few users claimed that they are responsible for lower footfall in cinemas.     The University of Colorado’s football team, led by head coach Deion Sanders, will play the University of Central Florida Saturday in Orange County, Florida.

    Hurricane Helene has wreaked havoc in recent days across multiple states, including Florida, with a death toll over 40 and an expected $15 billion to $26 billion in property damage.

    Despite this destruction, Colorado’s social media team posted on social media Friday a computer-designed graphic showing safety Cam’Ron Silmon-Craig standing on a Florida beach with water up to his knees. 

    The post said “24 hours,” an apparent reference to the countdown to the game Saturday. The post was later deleted from Colorado’s social media account.

    The image also had a sign in the background that said “Beware of Sharks,” an apparent reference to Silmon-Craig’s nickname, “Shark.” 

    Fox News Digital has reached out to the Colorado football program for comment but had not received a response before the time of publication. 

    Flooding has been one of the biggest destructive forces of the hurricane, beginning along Florida’s coast well before Hurricane Helene made landfall, with rapidly rising waters reported as far south as Fort Myers on the state’s Gulf Coast.

    FOX Weather’s Ian Oliver said the surge quickly flooded streets around St. Pete Beach Thursday evening, with high tide several hours away.

    The hurricane made landfall in Florida’s Big Bend region, after intensifying into a catastrophic Category 4 hurricane with winds of 140 mph.

    The monster hurricane is unleashing a potentially “unsurvivable” 20-foot storm surge, catastrophic hurricane-force winds and flooding.

    The National Weather Service in Tallahassee issued a rare extreme wind warning for several counties in the Big Bend ahead of the approach of the eyewall.

    The National Hurricane Center (NHC) said there is a significant risk of a life-threatening storm surge along the entire west coast of the Florida Peninsula, as well as Florida’s Big Bend region because of Hurricane Helene’s massive size.

    Due to the storm, Saturday’s game between Colorado and UCF was moved inland to Orlando. 

    Sanders spoke about the weather before the Baylor game, saying the team was preparing as if it was not going to rain. Sanders bickered with a reporter who asked about his plans for the rain.

    “I’m one of those good weathermen … 30% (chance of rain) is 70% (chance) it won’t. Let’s do drills that say, ‘It won’t rain,’” Sanders said at a press conference this week. 

    The game will mark the first-ever meeting between Colorado and UCF. The Knights became a Division I program in 1996 and joined the Big 12 in 2023.

In the video, Ms Malhotra can be heard saying, “Feeling sluggish and drowsy after meals and unable to concentrate, then stop scrolling. The top reason why we feel sluggish after meals is a high-carb or a high-fat diet. Now, when these are digested, our body produces much more serotonin and melatonin, which make us drowsy.”

    Pooja Malhotra continues, “Another reason could be sleep deprivation from the previous night, which makes us drowsy immediately after a meal. Other reasons could be alcohol intake, lack of movement or medical conditions such as diabetes, insulin resistance, anaemia, sleep apnea, or abnormal thyroid levels.”

    The nutritionist further discusses what can be done to stay active after eating a meal.

    She writes in the caption

    1. Eat well-balanced meals

    When you eat a high-carb or high-fat diet, your body produces more serotonin and melatonin, which makes you drowsy. So, eating a well-balanced meal with all the nutrients is helpful.

    2. Small and frequent meals

    It reduces blood sugar levels and insulin resistance. While small meals prevent overeating, frequent meals maintain stable energy levels throughout the day.

    3. Avoid too much alcohol

    Alcohol has the bad quality of disrupting digestion and causing blood sugar imbalances. Reducing the intake level can exacerbate drowsiness and maintain focus and alertness.

    4. Sufficient sleep

    What better than good-quality sleep? It not only replenishes the powerhouse of energy and reduces fatigue but also regulates hunger hormones. With reduced overeating, you can easily improve insulin sensitivity and glucose metabolism in your body. 

    5. Hydrate well

    Dehydration can cause fatigue and drowsiness. By being hydrated, your body will have better digestion and nutrient absorption.

    6. Regular physical activity

    A light 10-minute stroll after a big meal and other exercises will surely help. It boosts circulation and oxygenation, increases energy levels and alertness, helps regulate blood sugar and insulin levels, stimulates digestion and reduces bloating. 

    7. Soak in the early morning sun for a few minutes

    It regulates circadian rhythms, improving energy and alertness. Vitamin D levels essential for energy production are also boosted, helping to enhance mood and reduce fatigue.
